Free speech includes the right to offend

There have been two separate strands to the media coverage of the Shiv Sena's campaign against Rohinton Mistry's novel Such A Long Journey. The book was published years ago so my first reaction to the campaign was Such A Long Time! I mean, why bother after all these years? But the media have focused less on the time lag (perhaps it takes very long for the Thackeray family to read a book) and more on the politics of the campaign.

Many publications have made the point that this campaign is spearheaded by the youngest Thackeray, Aditya, who while upholding the Sena's twin traditions of chauvinism and nepotism, demanded that Bombay University delete Such A Long Journey from its syllabus. Journalists have argued that the (successful) campaign marks the emergence of the third generation of the Thackeray dynasty. (Actually, it maybe the fourth, given the Sena's insistence on venerating the memory of Bal Thackeray's father.) The second strand to the coverage has been more familiar. The usual suspects have held demonstrations urging the government to stand up to the Shiv Sena's 'blackmail.' Assorted Communists, Marxists and fellow travellers have spoken out for free speech. And the usual denunciations of the Shiv Sena have been duly issued. Both strands are valid and important. The Thackerays run a thuggish outfit and of course, we should all stand up to the Shiv Sena's bullying tactics, etc, etc. But my interest in the campaign is slightly different. I do not dispute that the book is inoffensive. It is clear that the passages that the Thackerays (and Maharashtra chief minister Ashok Chavan) find so repugnant represent the views of characters in the novel. And that of course, any novelist writing about Bombay in the early Seventies is obliged to include conversations that capture the subjects and views that were current in that era. Nor do I disagree that the Shiv Sena references are a side show. When I read the book (and I recommend it highly) many years ago, my sense of the content was that it was about the Nagarwala affair (remember that? If not, don't worry — it was a long time ago) and about the sense of dread that pervaded India as the forces that finally imposed the Emergency were gathering strength. So the Congress has more reason to complain than the Sena. My concern is that we have been conned into discussing the content of the novel at all. We worry about what it actually says about the Shiv Sena. We care whether Ashok Chavan (who clearly has the same problems with reading as the Thackerays and has only looked at a few paras) thinks that the book is offensive. And we are reduced to measuring the potential offence caused to the Shiv Sena and contrasting it with the potential offence to the Congress and to Indira Gandhi's fans. My point is that none of this is important. In a liberal society, books should be banned or proscribed only in the most extreme cases. If a book betrays national security secrets, or if it is defamatory, then there may be an argument for banning it. Perhaps a certain kind of obscenity (paedophilia, for instance) is also reason enough to justify banning a book. Otherwise, there is no case at all for any kind of ban. As nobody believes that Such A Long Journey deals with paedophilia, reveals the names of Indian secret agents or commits defamation against an individual, it does not fall under any of the categories that would merit a ban. So, the content is irrelevant. Perhaps the Sena comes off badly in the dialogue. Perhaps it doesn't. Either way, it does not matter. To sit around discussing the content (let alone defending it) is to play the game of those who would ban books. In India, unlike in most Western liberal societies, we sometimes make up a new reason for banning books: we say that they offend communities. In fact, the point of free speech is to cause offence. If nobody is offended by anything that somebody says or writes, then there is no need for a constitutional guarantee of freedom of expression. The reason such a guarantee exists is to protect those who say things that provoke or offend. Do not protect those who cause offence and you might as well kiss the right to free speech goodbye. There are enough examples in recent history to demonstrate the West's commitment to free speech. Though Salman Rushdie had to go into hiding after the fatwa, Western countries refused to ban The Satanic Verses. Despite protests from many Muslim countries, Denmark protected (rather than penalised) the cartoonist who drew the offensive caricatures of the Prophet. No Western country has banned those cartoons. Unfortunately, we have no such commitment to free speech. We brag about it as a constitutional right and yet, every time it comes to the crunch, we chicken out and give in to the book banners and the movie censors. We were the first country in the world to ban The Satanic Verses. Each time some community complains about a movie, our politicians rush to ban it. This can verge on the ridiculous. The UPA government would have censored The Da Vinci Code, a film that was a hit in every Western country on the grounds that it offended Christians (presumably there are no Christians in America or Europe where the film was widely exhibited) had Sharmila Tagore not put her foot down as head of the Censor Board. The film of Jesus Christ Superstar — bizarrely enough! — is banned in India. When politicians are told that they are curtailing the right to freedom of expression, they trot out a new justification. They say that if the book / movie in question was not banned, there would be riots and so they were acting to keep the peace. In fact, this is the worst possible justification because what the politicians are telling the protestors is this — if you want something banned, then just resort to violence and we will promptly use that as an excuse to ban it. In the circumstances, is it so surprising that violent Hindu protestors drove the unit of Water out of Banaras even as the BJP government refused protection? Is it so surprising that every time a fringe organisation wants publicity it attacks a cinema hall or assaults booksellers? Our politicians have assured vandals that the best way to abridge the right to free speech and to hit the headlines claiming victory is to break a few heads or maybe cause some deaths. You can argue that nobody wants to ban Such A Long Journey. They just want to remove it from a syllabus. But the arguments are the same as those for a ban. And besides, most arguments for bans are framed in terms of the offence caused to ordinary people. In this case, ordinary people are still able to buy the book. It is the specialists, those with a serious interest in literature, who have been denied the opportunity to study it. So yes, the Thackerays are thugs. And yes, Ashok Chavan should not have said what he did. And yes of course, there is nothing really offensive about the book. But none of this matters. Even if the Thackerays were peace-loving, even if Ashok Chavan behaved differently and even if Such A Long Journey's characters said something that offended the Shiv Sena, there would still be no case for a ban. Start compromising because of offence, real or imagined, and eventually the right to free speech will be worth nothing at all. Exclusive to TNSE. More at www.virsanghvi.com. The Wisconsin Badgers are getting ready to take on the Iowa Hawkeyes at 3:30 p.m. ET on ESPN.

After an outstanding upset over the previously No. 1 Ohio State Buckeyes, the Badgers are looking to continue their momentum as they travel to Iowa City to try and defeat the Hawkeyes.

Looking down the Badgers’ schedule, the Hawkeyes may be the only team standing in their way of Big Ten dominance.

The Northwestern Wildcats played a close game with the Michigan State Spartans, but this team seems to have trouble finishing as the Spartans look like they will pull off the 8-point win.

Wisconsin’s only loss is to the undefeated Spartans.

The Badgers are currently ranked No. 13 in the BCS rankings, and a win over the No. 15 Iowa Hawkeyes could push them into the top 10.

This game is definitely worth tuning in for (even if you’re not a fan of either team).
